Terms & Conditions
Nix Wedding Planner — ICE Luxury Weddings & Events, Bali, Indonesia.
These Terms & Conditions apply to all wedding planning, coordination, styling, décor, production and related services provided by Nix Wedding Planner (“Nix”, “we”, “us” or “the Planner”) to the Client (“you” or “the Client”).
By accepting a proposal, quotation, invoice or agreement issued by Nix, and/or by making payment of the required deposit, the Client confirms that they have read, understood and accepted these Terms & Conditions.
1. Services
Nix provides professional wedding planning, coordination, styling, décor management, production and related event services as outlined in the Client’s individual proposal, quotation, package or agreement.
The exact services included will be those specifically stated in the agreed proposal or invoice.
Any services, products, staffing, equipment or requirements not expressly included are considered additional and may incur additional charges.
Nix may coordinate and manage third-party suppliers and vendors on the Client’s behalf. Unless specifically stated otherwise, these suppliers remain independent third-party businesses and are responsible for their own products, services, staff and performance.
2. Proposals, Quotations & Pricing
All quotations and proposals are based on the information available at the time of preparation.
Pricing may change if:
- Guest numbers change
- The Client changes the scope of the wedding
- The venue, date or requirements change
- Additional services or products are requested
- A supplier changes its pricing
- Government taxes, venue charges, delivery fees or other compulsory charges change
- Additional labour, transportation, accommodation, equipment or production requirements become necessary
A quotation is not considered confirmed until the required deposit has been received and the booking has been accepted by Nix.
3. Deposit & Booking Confirmation
A booking is confirmed only once the required deposit has been received by Nix.
Payment of the deposit constitutes acceptance of these Terms & Conditions and confirms the Client’s agreement to proceed with Nix under the agreed proposal and these Terms & Conditions.
Unless otherwise agreed in writing, deposits and planning fees are non-refundable once services, planning time, supplier negotiations, bookings or other work have commenced.
The deposit secures Nix’s availability for the agreed wedding date and enables Nix to begin planning, administration, supplier coordination and procurement.
4. Payment Schedule
All invoices must be paid according to the payment schedule provided by Nix.
Payments must be made by the due date stated on the relevant invoice.
Nix reserves the right to pause planning, supplier bookings, production, procurement or other services where an invoice remains unpaid.
If outstanding payments are not received within the required timeframe, Nix may suspend services or cancel the Client’s booking, subject to the terms of the individual agreement.
Any costs incurred by Nix or third-party suppliers as a result of late payment remain payable by the Client.
5. Final Payment
The final balance must be paid by the date stated on the Client’s invoice or agreement.
Nix may require full payment before the wedding event takes place.
Nix is not required to provide services, release supplier payments, confirm outstanding bookings or proceed with event production where the Client’s account is overdue.
6. Changes to the Wedding
Wedding planning is an evolving process. Clients may request reasonable changes; however, changes may affect pricing, availability and timelines.
Changes to:
- Guest numbers
- Venue
- Wedding date
- Menu
- Décor
- Florals
- Entertainment
- Production
- Furniture
- Lighting
- Styling
- Timings
- Accommodation
- Transportation
- Ceremony requirements
- Any other agreed element
may result in additional costs.
All significant changes must be approved by the Client in writing.
Once a supplier has been booked, deposits or payments made to that supplier may be non-refundable and may be subject to that supplier’s cancellation and amendment policies.
7. Guest Numbers
The Client is responsible for providing accurate guest numbers by the deadlines requested by Nix.
Changes to guest numbers after final confirmation may result in additional costs.
Where suppliers charge per person, the Client remains responsible for the confirmed number of guests even if fewer guests ultimately attend, subject to the relevant supplier’s terms.
8. Third-Party Suppliers & Vendors
Nix frequently works with independent venues, caterers, florists, photographers, videographers, entertainers, DJs, musicians, production companies, transportation providers, accommodation providers and other third-party suppliers.
Nix will use reasonable care when recommending and coordinating suppliers but does not guarantee the performance, availability, quality, conduct or continued operation of any independent supplier.
Where a third-party supplier fails to perform, becomes unavailable, changes its pricing, cancels, delays, or experiences circumstances outside Nix’s control, Nix will make reasonable efforts to assist the Client and source an appropriate alternative where possible.
Any additional cost associated with replacement suppliers or alternative arrangements will be the Client’s responsibility unless otherwise agreed in writing.
9. Supplier Payments
Where Nix collects funds from the Client for payment to third-party suppliers, those funds may be used to secure or pay for the relevant supplier services.
Supplier deposits and payments may be non-refundable.
The Client acknowledges that once funds have been paid to a supplier, the supplier’s own cancellation, refund and amendment policies may apply.
10. Venue Rules
The Client agrees to comply with all rules and regulations imposed by the selected wedding venue.
This may include restrictions relating to:
- Noise
- Fireworks and special effects
- External catering
- Alcohol
- Entertainment
- Décor installation
- Candles and open flames
- Furniture
- Access times
- Event duration
- Load-in and load-out
- Cleaning
- Damage
- Guest behaviour
Any venue penalties, damage charges, overtime, additional cleaning or other charges caused by the Client, guests or Client-appointed suppliers may be charged to the Client.
11. Overtime
Services are provided according to the agreed schedule.
Additional planning hours, event-management hours, staff hours, supplier hours, venue hours, equipment hire or production time requested or required beyond the agreed scope may incur additional charges.
Overtime will be communicated to the Client where reasonably possible.
12. Décor, Florals & Creative Design
All styling, décor and floral concepts are developed based on the agreed creative direction, budget, venue and availability.
Flowers are natural products and may vary in colour, size, shape, seasonality and availability.
Where a particular flower, material, furniture item, product or design element becomes unavailable, Nix reserves the right to propose a reasonably comparable alternative.
Final styling may vary from reference images due to seasonal availability, venue conditions, scale, weather, logistics and supplier availability.
Reference images are intended as creative inspiration and do not constitute an exact guarantee of reproduction unless specifically agreed in writing.
13. Weather & Outdoor Events
For outdoor weddings and events, weather conditions remain outside the control of Nix.
Where weather creates a risk to guests, staff, suppliers, equipment or the event, Nix may recommend moving, modifying or postponing elements of the event.
The Client acknowledges that additional costs may arise from weather-related changes, including tents, flooring, transportation, labour, venue changes, equipment and alternative décor.
Nix will make reasonable efforts to protect the event and provide practical alternatives but cannot guarantee that an outdoor event will remain unaffected by weather.
14. Force Majeure
Nix will not be liable for failure, delay or interruption caused by circumstances beyond its reasonable control.
This may include, without limitation:
- Natural disasters
- Severe weather
- Earthquakes
- Flooding
- Volcanic activity
- Fire
- Government restrictions
- Political instability
- Civil unrest
- Epidemics or pandemics
- Transportation disruption
- Venue closure
- Supplier failure caused by circumstances beyond their control
- Strikes
- Power outages
- Acts of God
- Other circumstances reasonably beyond Nix’s control
Nix will make reasonable efforts to assist the Client with alternative arrangements.
Any additional costs arising from such circumstances will generally remain the responsibility of the Client unless otherwise agreed in writing.
15. Cancellation by the Client
If the Client cancels the wedding or Nix’s services, the Client must notify Nix in writing.
Planning fees, deposits, supplier payments and other amounts already incurred may be non-refundable.
The Client remains responsible for any outstanding non-refundable commitments made on their behalf.
Where cancellation occurs after substantial planning, procurement or supplier commitments have been undertaken, additional cancellation charges may apply.
Any refund will be determined in accordance with the individual agreement, these Terms & Conditions and the applicable supplier terms.
16. Change of Wedding Date
A request to change the wedding date is treated as a change to the original booking and is subject to Nix’s availability.
A date change may result in:
- Additional planning fees
- Supplier cancellation fees
- New supplier pricing
- Venue charges
- Loss of deposits
- Additional accommodation or transportation costs
- Other costs associated with moving the event
A date change is not confirmed until agreed in writing by Nix.
17. Client-Appointed Suppliers
If the Client appoints their own suppliers without prior consultation with Nix, those suppliers must comply with venue rules and the agreed event schedule.
Nix is not responsible for the performance, conduct, delays, damage or additional costs caused by Client-appointed suppliers.
Where additional planning, coordination or management is required because of a Client-appointed supplier, additional fees may apply.
18. Client Responsibilities
The Client agrees to:
- Provide accurate information
- Respond to planning requests within reasonable timeframes
- Make payments when due
- Provide final guest numbers and event information by the required deadlines
- Inform Nix of relevant dietary, accessibility or special requirements
- Follow venue rules
- Provide accurate names and information required for bookings
- Obtain any personal documentation required for their own legal or travel arrangements
- Communicate material changes promptly
- Treat Nix staff and suppliers respectfully and professionally
Nix cannot be held responsible for delays or additional costs caused by inaccurate, incomplete or late information supplied by the Client.
19. Communication & Approvals
The Client authorises Nix to communicate with venues and suppliers on the Client’s behalf in relation to the agreed wedding arrangements.
Where an important decision, cost or change requires Client approval, Nix will seek confirmation from the Client.
Written approval by email, messaging platform or other agreed communication channel may constitute approval.
The Client is responsible for reviewing quotations, invoices, proposals and confirmations before approving them.
20. Emergency Decisions
On the wedding day, circumstances may arise requiring immediate decisions in order to protect guests, staff, equipment, the venue or the smooth operation of the event.
Where the Client is unavailable, Nix may make reasonable operational decisions in the best interests of the event.
Such decisions may include changes to timing, layout, supplier positioning, weather plans or operational arrangements.
21. Liability
Nix will exercise reasonable skill and care in providing its services.
However, Nix is not responsible for loss, damage, injury, delay or failure caused by circumstances outside its reasonable control or by the acts or omissions of independent third parties.
To the extent permitted by applicable law, Nix’s liability shall be limited to the fees actually paid to Nix for the specific services giving rise to the claim.
Nothing in these Terms & Conditions excludes liability that cannot legally be excluded under applicable law.
22. Personal Belongings
The Client and guests are responsible for their personal belongings, jewellery, phones, passports, money, gifts and other valuables.
Nix is not responsible for lost, stolen or damaged personal property unless caused directly by Nix’s proven negligence.
23. Intellectual Property & Creative Work
All original concepts, planning documents, design concepts, mood boards, proposals, layouts, creative concepts, written materials and other intellectual property developed by Nix remain the property of Nix unless otherwise agreed in writing.
Such materials may not be reproduced, distributed, copied or provided to another planner, stylist, decorator or supplier for the purpose of reproducing Nix’s work without written permission.
24. Portfolio & Social Media Rights
The Planner, Stylist and/or Decorator retains the right to photograph, record and showcase the planning, styling, décor, floral design, production and other creative work produced or coordinated for the Client’s wedding for the purposes of its professional portfolio, website, social media, advertising, marketing, editorial submissions and other legitimate business promotion.
Such use may include photographs and videos of the venue, décor, florals, tablescapes, installations, stationery, styling, production and other design elements.
Nix will take reasonable care not to intentionally identify or prominently feature the Client or wedding guests without the appropriate permission.
Where professional photographs or videos produced by a third-party photographer or videographer are used, Nix will only use such material where it has the appropriate permission or licence from the relevant copyright holder.
Payment of the deposit constitutes the Client’s acceptance of these Portfolio & Social Media Rights.
If the Client requires the wedding to remain completely private and does not wish images of the décor, styling, florals or production to be used for portfolio or promotional purposes, this must be agreed in writing with Nix before payment of the deposit.
25. Photographer & Videographer Credits
Where Nix publishes professional photographs or videos supplied by a third-party photographer or videographer, Nix will make reasonable efforts to provide appropriate credit where requested.
The Client acknowledges that the copyright in professional photography and videography may belong to the relevant photographer or videographer.
26. Marketing & Supplier Collaboration
Nix may collaborate with venues, photographers, florists, production companies and other wedding professionals to showcase completed events.
This may include publication of décor, styling, floral arrangements, venue details and other non-identifying elements of the wedding.
Where required, appropriate supplier credits may be included.
27. Confidentiality & Privacy
Nix will take reasonable care in handling Client information and will not intentionally disclose private personal information except where reasonably necessary to provide the agreed services or where required by law.
Clients should notify Nix in writing of any specific confidentiality requirements before planning begins.
28. Children & Guest Safety
Parents and guardians remain responsible for children attending the wedding.
Guests remain responsible for their own safety and behaviour.
Nix is not responsible for injuries, accidents or incidents arising from guest conduct, alcohol consumption, unsafe behaviour or failure to follow venue or event instructions, except to the extent caused by Nix’s proven negligence.
29. Alcohol & Guest Conduct
Where alcohol is served, the Client and guests are expected to behave responsibly and comply with venue and supplier rules.
Nix may request that a guest be removed from an event where their behaviour presents a risk to themselves, other guests, staff, suppliers or property, subject to the venue’s policies and applicable law.
30. Taxes, Bank Fees & Currency
Unless otherwise stated, quoted prices are based on the currency shown on the relevant proposal or invoice.
Bank charges, international transfer fees, currency conversion costs and payment processing fees may be payable by the Client unless otherwise agreed.
Applicable taxes, government charges and mandatory fees will be charged where required.
31. Expenses
Additional expenses reasonably incurred by Nix in delivering the agreed services may be charged to the Client where they fall outside the agreed package or budget.
Examples may include:
- Transportation
- Accommodation
- Meals for extended event days
- Additional staffing
- Printing
- Courier fees
- Delivery
- Storage
- Emergency purchases
- Additional production requirements
- Last-minute client requests
Where reasonably possible, Nix will seek approval before significant additional expenses are incurred.
32. Final Event Details
The Client must approve final event details, schedules, menus, guest numbers, layouts and other relevant information by the deadlines communicated by Nix.
Once final details have been approved, changes may incur additional charges and may not be possible.
33. On-the-Day Coordination
On-the-day coordination covers the agreed event period and agreed scope of services.
It does not automatically include unlimited additional planning, supplier management, guest services, personal assistance, accommodation management or post-event services unless specifically included.
34. Damage & Loss
The Client is responsible for damage caused by the Client, their guests or Client-appointed suppliers to:
- Venue property
- Rental equipment
- Furniture
- Décor
- Production equipment
- Florals
- Other supplier property
- Nix property
Any resulting repair, replacement, cleaning or penalty charges may be charged to the Client.
35. Right to Refuse or Suspend Services
Nix reserves the right to suspend or terminate services where:
- Payments are materially overdue
- The Client repeatedly breaches the agreed terms
- The Client or a representative behaves abusively, threateningly or disrespectfully toward Nix staff or suppliers
- The Client requests unlawful activity
- Continuing the relationship would create an unreasonable risk to Nix, its staff or suppliers
- The Client materially misrepresents information relevant to the wedding
Any termination will be subject to applicable law and the individual agreement.
36. Disputes
The parties agree to first attempt to resolve any dispute through good-faith communication and negotiation.
Where a dispute cannot be resolved informally, the parties may seek mediation or other appropriate dispute-resolution procedures before commencing formal proceedings, where appropriate.
The governing law and jurisdiction applicable to the Client’s agreement will be stated in the individual contract.
37. Entire Agreement
The Client’s signed agreement, accepted proposal, approved quotation, invoices and these Terms & Conditions constitute the agreement between the Client and Nix in relation to the services provided.
Any amendment or variation must be agreed in writing.
Where there is a conflict between an individual signed agreement and these Terms & Conditions, the specific signed agreement will take precedence to the extent of the inconsistency.
38. Acceptance
By signing the agreement, accepting the proposal or making payment of the required deposit, the Client confirms that:
- They have read these Terms & Conditions
- They understand the services and payment obligations
- They accept the cancellation and supplier conditions
- They understand that third-party suppliers operate independently
- They accept the Portfolio & Social Media Rights
- They understand that additional costs may arise from changes or circumstances outside Nix’s control
- They agree to be bound by these Terms & Conditions
